What You Should Know About the Home Closing Process: An Interview with Jim Feldman of Johnny Gardner Law Group

Tell us a little bit about your experience, company history and the services you offer.

Johnny Gardner Law Group is a full service firm of four attorneys working in diverse areas of the law. The firm has a location in downtown Conway and Myrtle Beach. Jim Feldman heads up the real estate department with more than sixteen years of experience in residential closings. He is licensed to practice law in New York as well as South Carolina, handling all aspects associated with home buying transactions.

What's the role of an attorney in home closings in South Carolina?

State law requires that a South Carolina licensed attorney actually close all sales or mortgage refinances. Once a sales contract is in place, the firm is engaged by the buyer and or seller directly to represent them throughout the process.

Is there a common misunderstanding that you've noticed potential sellers and buyers have about the process?

The laws of each State differ with regard to home closings. Some buyers and sellers are accustomed to working with "title companies" instead. In South Carolina, quite often, a closing attorney acts as a title insurance agent as well. This allows the attorney to complete the process with the buyer without the need to contract with additional parties to perform the services needed.

What is something about buying or selling a home in South Carolina that most people aren't aware of that they should know?

South Carolina is a true recording state. Therefore funds are not disbursed at the closing table, nor is access to the home typically granted to the new owner, until such time as the proper documents are recorded in the County courthouse.

What are one or two things that the seller can do to help make the home closing process easier?

Provide a copy of your current Deed and existing Title Insurance Policy to the closing attorney's office. Often times there could be past open title issues that may have been addressed and corrected when the seller bought the home. That work product may be useful if those same concerns arise for the new buyer.

What are one or two things that the buyer can do to help make the home closing process easier?

Plan for the unexpected. Give yourself some leeway with work and travel if you are focusing on a particular date for closing. Things happen, and you do not want to come into town specifically for a scheduled time that gets moved for reasons outside of your control. And lastly, for both buyers and sellers, use and rely on your realtor and attorney. They are here working for you and usually have a lot more experience with closings than you may have. Ask them questions and be responsive to inquires from them.
